The Ministry of the Environment and Energy Security (MASE) has updated the operational instructions for filling out the chronological waste loading and unloading register and the waste identification form (FIR).

The updates are contained in Directorial Decree No. 210 of July 31, 2026, which amends the procedures previously established by Directorial Decree No. 251 of December 19, 2023. The measure approves two new documents—annexed to and forming an integral part of the decree—designed to replace and update the prior application guidelines regarding the models regulated by Articles 4 and 5 of Ministerial Decree No. 59 of April 4, 2023, which is one of the regulatory pillars of the RENTRI system.

Chronological Loading and Unloading Register

The first document, contained in Annex 1, covers instructions for filling out the form required under Article 4 of M.D. No. 59/2023 regarding the chronological waste loading and unloading register. The guidelines have been updated with the July 2026 revision to make the obligations clearer for entities required to keep the register, standardizing operational procedures and offering guidance aligned with practical needs that emerged during the system’s rollout.

Updates for the Waste Form (FIR)

The second document, set out in Annex 2, contains the new compilation instructions for the form governed by Article 5 of M.D. No. 59/2023—namely, the waste identification form. This is also an updated July 2026 revision aimed at facilitating correct completion of the form and clarifying practical aspects that might create interpretive or operational doubts for operators handling and transporting waste.

Clarifications and Corrections to Previous Instructions

MASE’s intervention goes beyond a formal review of the documentation. The new instructions were also prepared to coordinate form content with clarifications already provided through fact sheets and FAQs published on the RENTRI portal. The goal is to consolidate useful completion guidelines into organized, up-to-date documents, preventing discrepancies between formal instructions and guidance released during system implementation.

Additionally, the changes eliminate several typographical errors from previous versions and incorporate further operational guidance drawn from user experience. The update affects both formal aspects of the templates and practical rules for completion and use.

A More Uniform System for Operators

Ultimately, the revision aims to standardize how obligated entities complete the chronological register and the form. Clearer instructions should facilitate compliance with RENTRI rules and reduce errors in managing documentation. Operators should refer to the updated instructions approved by Directorial Decree No. 210/2026, checking the guidance in both annexes for specific duties.

Paper FIR Until September 15, 2026

The transitional period for the waste identification form must also be considered. Until September 15, 2026, the FIR may still be issued in paper format as an alternative to the digital procedure specified in Article 7 of M.D. No. 59/2023. This deadline is particularly significant, as it coincides with another step toward full operation of digital procedures tied to RENTRI.

Penalties for Data Transmission Take Effect in September

Starting September 15, 2026, penalties for failing to transmit or incompletely transmitting FIR data to RENTRI will also take effect. This effective date was set by Article 13 of Law No. 26 of February 27, 2026, converting Decree-Law No. 200 of December 31, 2025 (the “Milleproroghe” decree).

This timeline makes MASE’s updated instructions crucial: affected operators must familiarize themselves with the new register and FIR completion procedures before moving to the next system phase, where data transmission obligations and penalties apply in full.

The 2025 Workplace Safety Decree (Law Decree no. 159 of 31 October 2025) has been published in the Official Gazette, introducing important amendments to Legislative Decree 81/2008 concerning health, safety and construction sites. The aim of the measure is to strengthen the culture of prevention, increase traceability and digitalise safety management processes. The main new provisions concern the introduction of the digital construction-site badge, the tightening of the credit-based licence, new provisions on PPE, training, health surveillance and an INAIL reward system for virtuous companies.

The information currently available comes from preliminary versions and may be subject to change until the final text is approved.

One of the most significant points is the strengthening of the role of the Workers’ Safety Representative (RLS). All companies with employees will have to identify an RLS, with no possibility of waiver through an agreement between the parties. The designated worker must complete the mandatory 32-hour training before formal appointment and maintain the annual refresher training of 4 or 8 hours, depending on the number of workers. The new decree also provides that, for companies employing fewer than 15 workers, national collective bargaining will regulate the procedures for the periodic refresher-training obligation, in compliance with the principle of proportionality and taking into account the size of the company and the level of health and safety risk arising from the activity carried out. A strengthening of training and supervision is also envisaged, with the aim of increasing awareness and prevention within companies.

The decree also introduces important measures for strengthening controls and traceability on construction sites. All companies operating under contract or subcontract, whether public or private, will have to provide workers with an identification badge with a unique anti-counterfeiting code, also in digital format, interoperable with the SIISL platform. The National Labour Inspectorate (INL) will focus its supervisory activities on subcontracting companies and, from 2026, credits on the credit-based licence will also be deducted on the basis of new sanctionable cases, with updated amounts and stricter procedures. A strengthening of the INL is also planned, with 300 new hires between 2026 and 2028 and an increase in the Carabinieri Labour Protection unit, in order to make inspection activity more effective.

Health surveillance and the role of the occupational physician

The decree clarifies that the health checks provided for by the Consolidated Act or ordered by the occupational physician must be counted as working time, with the exception of pre-employment checks. With the introduction of the new letter a-bis to art. 25 of Legislative Decree 81/2008, the occupational physician also takes on the task of informing workers about the importance of cancer prevention, promoting participation in the screening programmes provided for by the Essential Levels of Care (LEA), including through information campaigns prepared by the Ministry of Health.
Health surveillance also includes the targeted medical examination in the event of a well-founded suspicion of alcohol or narcotic or psychotropic substance use, to be carried out before or during the work shift for duties classified as high risk under Law 125/2001 and Presidential Decree 309/1990. The decree extends to 31 December 2026 the deadline for revising the procedures for alcohol and drug-dependence checks provided for by art. 41, paragraph 4-bis of Legislative Decree 81/08.

In summary, the 2025 Workplace Safety Decree marks a decisive step towards a more modern, integrated and digital safety system, aimed at strengthening prevention, enhancing training and protecting workers’ health more effectively. The measure is currently being converted into law and will be completed by the implementing decrees that will define its operational and application aspects.

Six months after the publication of the new State-Regions Agreement on training, we take a closer look at some of the most frequently asked questions.

Is training in the workplace mandatory?

Health and safety training is mandatory because it is an essential tool for the prevention of accidents and occupational diseases.

All persons present in the company, from Workers to Managers, must receive training that is appropriate and updated in relation to the risks connected with their activity, so that they can work safely and responsibly.

A trained worker is an aware resource, capable of recognising hazards and actively contributing to company safety.

Who is responsible for ensuring training for workers?

The responsibility for ensuring training lies with the Employer, who must guarantee each Worker, Supervisor and Manager a training pathway suited to their duties and to the risks present in the company. Training is therefore not only an obligation for those who attend it, but also a management responsibility for those who organise and promote it, ensuring that training pathways are consistent with employees’ risks and tasks.

How can you understand which courses must be attended?

Training courses are defined on the basis of the role held and the risks present in the work activity.
The new Single State-Regions Agreement of 17 April 2025 identifies specific pathways for Workers, Supervisors, Managers, Employers, RSPPs, Coordinators and Equipment Operators, indicating for each of them the duration, methods and frequency of refresher training.

When must training be carried out?

Training must be carried out before or at the same time as the start of the work activity, so that the Worker knows the risks and the correct safety procedures before being exposed to the tasks, and it must be repeated or supplemented in the event of changes in role or the introduction of new risks.

How often must training be updated?

Training must be updated periodically to ensure that knowledge and skills remain appropriate to the actual risks. The new Single State-Regions Agreement of 17 April 2025 confirms that the frequency of refresher training varies according to the role: generally every 5 years for Workers, Managers and Employers, while for Supervisors refresher training is required every 2 years.

The objective is to maintain awareness of risks and the effectiveness of prevention measures over time.

How is training documented?

Training is documented through attendance registers, learning assessments and the issue of the final certificate. All documentation must be kept by the Employer, who guarantees its traceability also for courses delivered remotely.

In what ways can training be delivered (in person, online, etc.)?

Training can be delivered in four ways:

In person: lessons held physically in a classroom or suitable spaces, with theoretical and practical activities.

By synchronous videoconference (VCS): real-time remote participation, with an individual connection from a PC or tablet. The use of a smartphone is not permitted.

In e-learning: training through a digital platform that guarantees traceability, verification of participation and learning tests.

In blended mode: a combination of in-person lessons and remote activities, to integrate the theoretical and practical parts in a balanced way.

Whatever method is chosen, attendance control, active participation and verification of learning must be guaranteed.

When can training be followed remotely and when is classroom attendance mandatory?

The possibility of carrying out training remotely depends on the type of course and the activities involved.

Theoretical training: may be delivered by synchronous videoconference or in e-learning mode, provided that individual participation, traceability of activities and verification of learning are guaranteed.

Practical training, on the other hand, must always be carried out in person, especially when it concerns the use of work equipment or training in the use of category III personal protective equipment (PPE).

In these cases, physical attendance is essential to ensure the actual acquisition of operational skills.

What consequences may arise from failure to attend or update mandatory training?

Failing to attend or update mandatory training courses means not being compliant with safety regulations. In these cases, the Worker cannot perform certain activities, and the Employer risks administrative or criminal penalties. In addition to the legal aspects, training that is not up to date increases the possibility of errors and accidents, reducing the overall protection of those who work.

CSIA remains, as always, available for any further information.

The medical examination at the end of the employment relationship is an examination carried out by the Occupational Physician when the employment relationship ends, in order to check the Worker’s health.

Within Legislative Decree 81/2008, specifically article 41, paragraph 2, letter e, reference is made to the “medical examination upon termination of the employment relationship, mandatory in the cases provided for by law”.

This examination is important because the Occupational Physician assesses the Worker’s health conditions at the end of an activity that exposed them, on behalf of and by reason of their job duties, to health risks, and verifies any consequences that the work activity has caused to their health. For this very reason, this examination is in fact also a valid protection tool for the Employer, not only for the Worker.

Furthermore, from a broader perspective, carrying out an examination after the Worker has performed a task for a long period of time also makes it possible to assess any hazards and health issues that may involve other workers.

In particular, the legislation provides that the medical examination at the end of the employment relationship is mandatory in cases where the Worker has performed duties involving:

exposure to chemical agents

exposure to asbestos

exposure to ionising radiation

And in the event of exposure to other risks?

To date, according to the legislation, there are no other cases in which the end-of-employment medical examination is expressly mandatory. However, there are other cases in which the end-of-employment medical examination is recommended, especially for workers who have performed duties involving:

exposure to physical agents

exposure to carcinogenic and mutagenic agents

biological risk

other risks (manual handling of loads, vibrations, etc.)

In conclusion, what must the Employer do? In the cases described above, the company must promptly notify the occupational physician before the Worker’s actual termination (resignation, dismissal, retirement, contract expiry, etc.), so that there is sufficient time to organise the end-of-employment examination while the Worker is still employed: if the occupational physician is notified when the Worker has already ended the employment relationship, it will no longer be possible to organise the medical examination.

If the employment relationship has been of very short duration (less than one year), it is always advisable to assess together with your occupational physician the actual need to organise the end-of-employment medical examination.

THE NEW “SINGLE” AGREEMENT CONCERNING HEALTH AND SAFETY TRAINING AT WORK

The Training Agreement was published in the Official Gazette on 24 May 2025, approved on 17 April 2025 within the State-Regions Conference.

It is therefore finally possible to identify the final deadline by which companies must comply with the new training obligations: 23 May 2026.

We recall that the agreement, signed between the Government, the Regions and the Autonomous Provinces of Trento and Bolzano pursuant to article 37, paragraph 2, of Legislative Decree 81/08, reorganises and updates the training agreements already in force, establishing new rules on:

duration, minimum content and delivery methods for mandatory courses that fall within the responsibilities of Employers;

methods for final assessments for participants, valid for both initial training and refresher training;

monitoring and control of training activities and the correct application of the rules, with attention both to training bodies and to training recipients.

The new agreement precisely defines the mandatory training hours and refresher courses intended for Employers, Managers and Supervisors.

It also introduces new training obligations for the use of specific equipment and establishes targeted training pathways for those working in confined or potentially polluted environments.

The organisation of courses is also regulated – with limits on the number of participants, minimum attendance requirements, maximum trainer/learner ratio – as well as the delivery methods and final assessment.

Finally, the text clearly classifies the subjects authorised to carry out training activities.

The new provisions are numerous and significant, including:

The course for Employers: 16 hours of training divided into legal and organisational modules. For owners of construction companies operating on construction sites, an additional 6-hour module is required, with mandatory refresher training every 5 years of at least 6 hours, also available online.

The new definition of courses for Supervisors: a 12-hour course divided into four thematic areas, with refresher training every two years and in any case whenever necessary due to the evolution of risks or the emergence of new risks, with a minimum duration of 6 hours.

Training for Managers: reduced to 12 hours with refresher training of at least 6 hours every 5 years.

The introduction of new courses for confined environments: specific 12-hour training for workers, employers and self-employed workers operating in environments suspected of pollution or confined environments, with a mandatory 8-hour practical session. Refresher training must be carried out every five years and with a minimum duration of 4 hours relating to the practical part.

Qualification for the use of new operating machines:

agricultural fruit-picking machine: 8 hours (4 theory + 4 practice);

loaders for material handling: 8 hours (4 theory + 4 practice);

overhead travelling crane: 4 hours of theory + 6 hours of practice for the overhead travelling crane/gantry crane with cab control, or 6 hours of practice for pendant/radio control, or 7 total hours for both types.

The verification of effectiveness: which must be carried out by the Employer within a maximum of one year from the delivery of the training.

The new definition of training providers: the agreement clarifies the requirements for those delivering training and refresher courses, identifying three categories:

Institutional bodies;

Accredited bodies;

Other bodies such as joint bodies and sector interprofessional funds.

Transitional provisions:

During the initial application phase and in any case no later than twelve months from the entry into force of this agreement, courses may be started according to the provisions of the repealed State-Regions agreements as well as Annex XIV of Legislative Decree no. 81/2008 in force before the agreement entered into force.

In order to allow the full and effective implementation of the training obligations referred to in art. 37 of Legislative Decree no. 81/2008, employers are required to attend the training course so that it is completed no later than 24 months from the entry into force of the agreement.

Employer training courses already delivered on the date of entry into force of this agreement, whose contents comply with this agreement, are recognised. Refresher training for these courses starts from the course end date shown on the certificate.

THE IMPORTANCE OF THE HACCP SYSTEM

HACCP, an acronym for Hazard Analysis and Critical Control Points, is a food safety management system based on the analysis of hazards associated with food production and serving. Once physical, chemical and biological hazards have been identified, the HACCP method makes it possible to establish specific control measures (monitoring procedures, cleaning and hygiene plans, temperature checks, etc.) necessary to prevent or minimise the risks that may compromise product safety. The effective implementation of these practices is not only fundamental to guaranteeing the safety of food products throughout the supply chain, but also contributes to improving the reputation of food companies, giving them a competitive advantage on the market.

The implementation of HACCP offers numerous advantages, including:

Protection of public health

HACCP plays a fundamental role in preventing food-borne diseases. Through strict control of critical control points (CCPs) throughout the entire production process, it is possible to ensure that the risk of food contamination is minimised, guaranteeing products that are safe for human consumption. Implementing an effective HACCP plan, however, requires active collaboration among all parties involved in food production and distribution. It is therefore essential to train personnel so that they are aware of the procedures and hygiene practices to be followed. Staff training and awareness are key elements in ensuring that safety measures are applied correctly.

Regulatory compliance

The HACCP system is not only good practice; it is also a regulatory obligation. It was introduced in Europe through Directive 43/93/EC, transposed in Italy by Legislative Decree 155/97. Subsequently, from 1 January 2006, the “hygiene package”, a set of legislative texts of EU origin, has represented the reference legislation concerning hygiene in food production and the controls to which food must be subject. The hygiene package covers all aspects of the food production chain, from primary production through to sale to the consumer. In particular, the package includes:

(EC) 852/2004 of 29/04/2004 applicable to all food products;

(EC) 853/2004 of 29/04/2004 concerning food of animal origin;

(EC) 854/2004 of 29/04/2004 concerning specific rules for the organisation of official controls on products of animal origin intended for human consumption;

(EC) 882/2004 of 29/04/2004 concerning official controls performed to verify compliance with feed and food law and animal health and welfare rules.

Guarantee of product quality

A well-structured HACCP system allows constant improvement of production processes, with a consequent reduction in errors and inefficiencies and faster action in the event of deviations from critical limits. Constant monitoring of critical control points makes it possible to intervene promptly in the event of anomalies, ensuring that safety standards are always respected. This leads to greater consumer trust, which translates into a stronger reputation for the company and consistent product quality.

Competitive advantage

A clear commitment to food safety not only improves the company’s image, but can also attract new customers. In particular, many distribution chains and commercial partners require suppliers to have HACCP certification, making this system an essential requirement for accessing new markets and expanding commercially. In practical terms, the concepts of the HACCP system are implemented through the self-control manual, also known as the HACCP Manual. This manual must contain all information regarding the hygiene and health plan implemented by the company, detailed information on the company’s production processes, as well as on the equipment used and the characteristics of the work environments. Finally, it must clearly identify the critical control points and set out appropriate corrective actions to be taken if necessary. It is therefore clear that producing the HACCP manual is a complex process, since every company has different structural and production characteristics and the documentation must be in line with the type of activity carried out. There is no universal HACCP manual model that can be applied to all food businesses, because each company has unique characteristics linked to its structure, production processes and specific risks.

Continuous improvement

HACCP promotes a culture of continuous improvement and makes it possible to optimise production processes by reducing waste, improving operational efficiency and reducing costs associated with non-compliant or recalled products. This dynamic approach, thanks to the periodic review of the plan, allows companies to adapt more easily in the event of changes in production processes, the introduction of new machinery or products, or in response to legislative changes. The proper functioning of the entire self-control system depends first of all on the correct and timely application of the established procedures, but it is also possible that some aspects may need to be corrected or reviewed on the basis of experience and the results obtained over time. Once the self-control plan has been implemented and applied, it is necessary to have “proof” that what has been planned and implemented is truly effective and reliable. In this regard, a series of verification activities must therefore be arranged (inspections, checks, internal and/or external confirmations, chemical and microbiological analyses), the results of which constitute the reference data and information needed to establish whether the measures adopted are adequate.

In conclusion, therefore, the implementation and updating of the HACCP plan should not be seen as a burden, but as an opportunity to strengthen food safety management and guarantee the company’s long-term success. Food safety is a shared responsibility and HACCP is a fundamental tool for achieving this objective, improving the quality, reputation and efficiency of the business.

A recent incident reminds us how crucial it is to have a well-defined and constantly updated emergency plan.

On Wednesday 16 October, at the Court of Milan, around 500 people were evacuated due to the outbreak of a fire in the basement areas. Thanks to the prompt intervention of the fire brigade and the effectiveness of the evacuation procedures, no one was injured. This event, although brought under control, shows how important it is always to have a well-structured, known and updated emergency and evacuation plan.

The regulatory context: what does the law say?

According to the Consolidated Act on Health and Safety at Work (Legislative Decree 81/2008) and the Decree of 2 September 2021, all production activities meeting certain requirements are required to draw up an emergency and evacuation plan. These documents are essential to guarantee the safety of workers and users, especially in public places where the simultaneous presence of many people can complicate rescue operations.

What are the requirements for having an emergency plan?

It is mandatory for:

Workplaces with at least 10 workers.

Places open to the public with more than 50 people present at the same time.

Places included in Annex I of Presidential Decree no. 151 of 1 August 2011, which include activities with particular risks or complexity (e.g. industrial plants).

Why is it essential for a plan to be always up to date?

An effective emergency plan not only makes it possible to deal quickly with critical situations, but also prevents further risks arising from incorrect emergency management. An outdated document, in fact, may not be adequate for new safety provisions or structural changes to the building.

Training is the key to success

Updating workers on evacuation procedures is just as essential as keeping the plan itself up to date. In an emergency, every second counts: trained personnel know how to act promptly, minimising risks. Periodic simulations and drills make it possible to verify the effectiveness of the plan and the workers’ level of preparation, improving everyone’s safety.

Important!

It is essential that every company or workplace commits to keeping its emergency and evacuation plans updated and that training sessions are organised for all personnel. Only in this way will it be possible to guarantee an effective response to emergencies, minimising risks and protecting people’s lives.

If necessary, please do not hesitate to contact us to verify the compliance of your emergency plan and organise proper training for your employees. Prevention is the first step in avoiding accidents.
